Your privacy is important to CuBE Packaging Solutions, Inc. (“CuBE Packaging”). This Privacy Policy explains how CuBE Packaging collects, uses, discloses and retains personal information both online and offline, including personal information collected by CuBE Packaging through its website and telephone calls and when providing products or services.

2. Information CuBE Packaging Collects

In this Privacy Policy, “personal information” means information that identifies, relates to, describes or can be reasonably associated with an individual. The personal information we collect about you depends on your relationship and interaction with us. For example, we collect the following personal information in the following contexts:

  • Information You Provide
  • You may be asked to voluntarily give your personal information to CuBE Packaging when you interact with CuBE Packaging, including when you subscribe to a newsletter, request information, or purchase a product or service provided by CuBE Packaging. In those circumstances, you can choose not to provide certain requested personal information, but then you might not be able to proceed with your intended interaction or transaction with CuBE Packaging or otherwise receive the full benefit of the desired product or service.

  • Automated Collection
  • CuBE Packaging may automatically collect certain information regarding your use of CuBE Packaging’s website, such as geolocation of your device, the dates and times that you use the website, the browsers, operating systems, software and devices that you use to access the website and details of your use of the website.

    CuBE Packaging’s websites, email messages and advertisements may use technologies (e.g. cookies, web beacons, tokens, pixels or tags) to collect information that assists CuBE Packaging to improve CuBE Packaging’s products, services, customer communications and advertising and to prevent fraud.   • Information From Business Partners
  • If CuBE Packaging refers you to one of our business partners (e.g. a sales representative or broker) for a proposed product or service, then CuBE Packaging may collect information from that business partner regarding your transaction with them.

  • Information From Job Applicants
  • When you apply for a job with us, you provide us personal information including information relating to your employment and educational history.

3. Cookies & Tracking Technologies

4. How CuBE Packaging Uses Personal Information

CuBE Packaging uses your personal information collected by CuBE Packaging for purposes relating to or arising from your relationship and transactions with us and as otherwise set out in this Privacy Policy or permitted by applicable law, including:

  • to administer your relationship with CuBE Packaging, including to create and manage a confidential profile about you and your contract(s) with us, and to contact and correspond with you regarding those matters;
  • to provide products and services to you and facilitate payment for the same;

  • to facilitate your interactions and transactions with CuBE Packaging, including to process your applications, requests, orders and transactions and send notifications to you;

  • to provide you with promotional information or advertisements (including by email and other electronic messages) regarding CuBE Packaging and its products and services and related products and services offered by other businesses, to the extent permitted by applicable law;
  • to administer and facilitate your participation in contests and promotions related to CuBE Packaging;
  • to improve CuBE Packaging’s products and services and to develop new products and services;
  • to protect and enforce CuBE Packaging’s legal rights, interests and remedies, prevent fraud, and to protect the business, operations and customers of CuBE Packaging or other persons;

  • to enable and assist CuBE Packaging to collect, use, disclose and retain your personal information in accordance with this Privacy Policy;
  • to evaluate job applicants for employment with CuBE Packaging; and
  • otherwise with your consent.

5. How CuBE Discloses Personal Information

CuBE Packaging may disclose your personal information as follows:

  • Specific Consents
  • CuBE Packaging may disclose your personal information in accordance with your consent that you give during your interactions or transactions with CuBE Packaging.

  • Business Partners
  • If CuBE Packaging refers you to a business partner (e.g. sales representative or broker) for a proposed product or service, then CuBE Packaging may disclose your personal information to the business to facilitate the proposed transaction, and in those circumstances CuBE Packaging has no control over, or responsibility or liability for, the use, disclosure or retention of your personal information by the independent business, and the use, disclosure and retention of the disclosed information by the independent business is not subject to this Privacy Policy.

  • Suppliers and Service Providers
  • CuBE Packaging may disclose your personal information to CuBE Packaging’s suppliers and service providers (e.g., website developers, ecommerce partners, payment processors, shipping and fulfillment partners, etc.) to assist CuBE Packaging in the provision of information, products and services to you.

  • Law Enforcement/Legal Disclosures
  • CuBE Packaging may disclose your personal information as required or authorized by applicable law, including to comply with a subpoena, warrant or court or arbitral order or litigation disclosure obligation. CuBE Packaging may disclose your personal information to law enforcement agencies or other independent organizations if CuBE Packaging reasonably believes the disclosure is necessary or appropriate in connection with national security, law enforcement or other issues of public importance, or if CuBE Packaging reasonably believes the disclosure is necessary or appropriate to protect and enforce the CuBE Packaging’s legal rights, interests and remedies or to protect the rights, interests, business, operations or customers of CuBE Packaging or other persons (including to detect and prevent fraud and other illegal activities, enforce any of the terms of use, terms of service or other agreements that govern access to or use of any of the CuBE Packaging’s products or services). CuBE Packaging has no control over, or responsibility or liability for, the use, disclosure or retention of your personal information by the agencies, independent organizations or other persons to whom CuBE Packaging discloses the information in the foregoing circumstances, and the use, disclosure and retention of the disclosed information by those agencies, independent organizations or other persons is not subject to this Privacy Policy.

  • Business Transactions
  • CuBE Packaging may disclose your personal information in connection with a proposed or actual business transaction in which CuBE Packaging is involved (e.g., a corporate amalgamation, reorganization, merger or acquisition, or the sale or transfer of some or all of CuBE Packaging’s business or assets), but CuBE Packaging will require the information recipient to agree to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy and applicable law.

6. International Transfers of Personal Information

CuBE Packaging and its service providers may process, store and use your personal information at facilities in various countries, including Canada and the United States of America. The personal information protection laws of those other countries might be different from the laws of the jurisdiction in which you reside, and might permit courts, government, law enforcement agencies, regulatory agencies and security authorities to access your personal information without notice. By providing your personal information to CuBE Packaging, you consent to the transfer of the personal information to facilities located in other countries and the processing and storage of the personal information at those facilities.

7. Retention of Personal Information

CuBE Packaging retains your personal information for the period reasonably necessary for the purposes set out or referenced in this Privacy Policy and to comply with CuBE Packaging’s legal obligations or enforce or protect CuBE Packaging’s legal rights, or a longer period required or permitted by applicable law. CuBE Packaging will delete or dispose of your personal information, or depersonalize the information, when CuBE Packaging is no longer reasonably required to retain the personal information for the purposes set out or referenced in this Privacy Policy.

You may opt-out of receiving marketing emails from us by using the unsubscribe link at the bottom of the email or otherwise contacting us at the contact details below.

9. Your Privacy Rights

Depending on your jurisdiction of residence, you may have certain privacy rights, including the following. Please note that these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to Access / Know.
  • You may have a right to request access to personal information that we hold about you, including details relating to the ways in which we use and share your information. Residents of California have the right to know the categories of personal information we have collected about them, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing the personal information, and the categories of third parties to whom we have disclosed their personal information.

  • Right to Delete.
  • You may have a right to request that we delete personal information we maintain about you.

  • Right to Correct.
  • You may have a right to request that we correct inaccurate personal information we maintain about you.

  • Right of Portability.
  • You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.

  • Right to Withdraw Consent to Processing.
  • You may have the right to withdraw your consent to the collection, use and disclosure of your personal information, unless legal or contractual reasons prevent you from doing so. However, if you withdraw your consent, we may be unable to offer or provide you with certain goods and services.

Only you, or a person that you authorize to act on your behalf, may make a request related to your personal information. In the case of access, correction, and deletion, your request must be verifiable before we can fulfill the request. Verifying your request will require you to provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or a person authorized to act on your behalf. We will not discriminate against you for exercising your privacy rights.

10. Non-Personal Information

In addition to offering certain consumer rights (set forth in the section above), California law requires us to disclose the following additional information to California residents regarding our information practices.

In the last twelve (12) months, the personal information CuBE Packaging has collected falls into the following categories of personal information as defined under California law:

  • Identifiers and personal information categories listed in the California Customer Records statute, such as name, signature, address, phone number, email address, online identifier, IP address, date of birth, employment history, credit card number, and debit card number. We collect this category of information directly from you, automatically from your use of the website, from our business partners, and from job applicants.
  • Protected classification characteristics, such as age, race, color, ancestry, national origin, citizenship, and veteran or military status. We collect this category of information from job applicants.
  • Commercial information, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We collect this category of information directly from you, automatically from your use of the website, and from our business partners.
  • Internet or other similar network activity, such as browsing history, search history, information on a consumer's interaction with a website, application, or advertisement. We collect this category of information automatically from your use of the website.
  • Geolocation data, such as device location. We collect this category of information automatically from your use of the website.
  • Professional or employment-related information, such as current or past job history. We collect this category of information automatically from job applicants.
  • Non-public education information, such as transcripts. We collect this category of information automatically from job applicants.
  • Inferences drawn from other personal information, such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. We create this category of information based on other information we collect.
  • Sensitive personal information, such as geolocation, racial or ethnic origin, citizenship or immigration status. We collect this category of information automatically from job applicants, and we may collect precise geolocation automatically from visitors to the website. To the extent we collect sensitive personal information, we do not use it to infer characteristics about individuals.

CuBE Packaging does not sell personal information, however, certain of our digital advertising activities may constitute a sharing of personal information for cross-context behavioral advertising. In particular, we may share for the following categories of personal information with advertising and analytics partners for the purposes of cross-context behavioral advertising.

11. Non-Personal Information

CuBE Packaging creates and collects non-personal information (information that is not about an identifiable individual), including personal information that has been aggregated or otherwise depersonalized so that the information no longer relates to an identifiable individual. CuBE Packaging may use, disclose, transfer and retain non-personal information for any purpose and in any manner whatsoever, and commits not to attempt to re-identify this information. If non-personal information is combined with personal information, then CuBE Packaging will treat the combined non-personal information as personal information for the purposes of this Privacy Policy for as long as the non-personal information is combined with personal information.

12. Children’s Privacy

Our website and services are not intended for use by children under the age of 18 and we do not knowingly collect personal information from children under 18. If we learn we have inadvertently collected personal information from children under 18 years old, we will take steps to delete that information.

13. Other Websites and Businesses

CuBE Packaging’s website and correspondence (including emails, messages and social media posts) may include advertisements for products and services offered by independent businesses or links to websites operated by independent businesses. CuBE Packaging has no responsibility or liability for, or control over, those other websites, online services or businesses, their products or services, or their collection, use, disclosure or retention of your personal information. This Privacy Policy does not apply to the collection, use, disclosure and retention of your personal information by those websites, online services and independent businesses. If you have questions about how those websites, online services or independent businesses collect, use, disclose or retain personal information, please contact the owner or operator of the website, service or business.

14. Changes to this Policy

CuBE Packaging may update this Privacy Policy from time to time by posting a new version of this Privacy Policy on CuBE Packaging’s website. Your continued dealings with CuBE Packaging after any change to this Privacy Policy will signify your consent to the collection, use, disclosure and retention of your personal information as set out in the changed Privacy Policy. Accordingly, you should check the “Last Updated” date of this Privacy Policy (at the top of this Privacy Policy) and review any changes since the last version.
